Terms and Conditions

Welcome to www.realmscents.ae (the “Website”). For any purchases made, the terms “Realm Scents,” “we,” “us,”or “our” refer to Realm Scents FZE. We provide the products and services available on the Website. Your use of this Website is governed by these Terms and Conditions, along with our Privacy Policy and Refund Policy (collectively, the “Agreement”). By using any part of the Website, creating a customer account, and/or placing an order, you agree to be bound by the Agreement.

1. Use of the Website

Eligibility

You confirm that you are legally able to enter into contracts in your country of citizenship and that you hold a valid debit/credit card. You warrant that all personal information provided during registration is true, accurate, and current. If your details change, please email vivek@realmscents.ae immediately. You agree not to impersonate any person or entity, nor use a false or unauthorized name.

Privacy

Please review our Privacy Policy to understand how we use information submitted via the Website.

2. Placing an Order and Order Acceptance

You may place an order by following the on-screen instructions. After your order is placed, you’ll receive an acknowledgement with a payment reference and the amount charged to your card. You will then receive emails with your Invoice, Shipment number, and a Tracking number.

Unless we notify you that we cannot accept your order—or you cancel it—our acceptance and the contract between you and us are completed upon dispatch of the goods. To cancel after dispatch, please follow our Returns Policy & Procedure.

We may refuse an order if the item is out of stock, payment authorization is not obtained, or a product/pricing error is identified. We reserve the right to reject any purchase offer at any time. If we cannot fulfill your order after acknowledging it, we will notify you by email or phone.

3. Your Account

You agree to keep your password and account details confidential and to take reasonable steps to prevent unauthorized access. You are responsible for all activity under your account. If you suspect your password is compromised, contact us immediately. If you forget your password, please use the Forgot Password flow on our Website. All personal information is handled per our Privacy Policy.

4. Product Descriptions and Information Accuracy

We take reasonable care to ensure details, descriptions, and prices are correct. However, information (including product descriptions and colors) may occasionally be inaccurate or out of date. To the extent permitted by law, we do not warrant that Website content is accurate, complete, current, or error-free. Prices are confirmed only upon acceptance of your order (see Section 2).

5. Payment

All product prices shown include VAT (where applicable) and exclude delivery charges. Your total price equals product cost plus VAT and delivery charges (as shown at checkout). Payment methods are listed in the Payment section of the Website; major credit cards are accepted. Your account will be charged as stated in that section.

Additional import duties or taxes may be payable in some countries upon delivery; you are responsible for such charges. We cannot control or predict these amounts—please consult your local customs office before ordering. You must comply with all applicable destination-country laws and regulations; we are not liable for any breach by you.

You confirm that the payment card used is yours. All cardholders are subject to validation checks and authorization by the issuer. If authorization is refused or not obtained, we are not liable for delay or non-delivery.

6. Passing of Property

Legal ownership of goods remains with us until we receive full payment. Ownership reverts to us immediately if we refund that payment.

7. Risk

Risk in the goods passes to you upon delivery.

8. Delivery

We will deliver according to the option you select at checkout. Any quoted delivery timelines are indicative only. Orders may arrive in one or multiple shipments. Realm Scents accepts no liability for delays caused by third parties. Once you receive the goods, you assume all risk.

10. Samples

Any products, services, or samples provided are for personal use only. You may not sell or resell any products, services, or samples received from us.

11. Intellectual Property

All Website content—including text, graphics, logos, button icons, images, audio clips, data compilations, and software—and its compilation (the “Content”) is the property of Realm Scents, our affiliates, partners, or licensors.

The trademarks, logos, and service marks displayed (the “Trade Marks”) are the registered and unregistered marks of Realm Scents, our affiliates, licensors, or partners, and are protected by applicable trademark laws. All other trademarks not owned by the foregoing remain the property of their respective owners.

Except as permitted under the limited licence in Section 12 or as required by law, no Content, Trade Marks, or any portion of the Website may be used, reproduced, copied, sold, resold, accessed, modified, or otherwise exploited, in whole or in part, without our prior written consent.

12. Limited Licence

We grant you a limited, revocable, non-exclusive licence to access and make personal use of the Website. You may not frame or use framing techniques to enclose the Website or any part of it without our prior written consent.

This licence does not include the right to:
a) modify or download the Website or its contents (except for caching or as necessary to view content);
b) make any use of the Website or its Content other than personal use;
c) create derivative works from the Website or its Content;
d) collect account information for the benefit of another party;
e) use meta tags or “hidden text” utilizing our name or Trade Marks without our express written consent;
f) use robots, spiders, crawlers, or similar data-gathering/extraction tools, or take any action imposing an unreasonable burden on our infrastructure.

13. Copyright Infringement and DMCA Policy

If you believe any content on our Website or linked by us infringes your copyright, please notify vivek@realmscents.ae.

14. Third-Party Links

We are not responsible for the content of any off-Website pages or other sites linked to or from the Website. Links are provided for convenience and do not constitute endorsements. Accessing such sites is at your own risk. We do not warrant the offerings of, nor accept responsibility for, the actions, content, products, or services of such sites, including their privacy policies or terms. Review those policies

15. Submissions

We welcome enquiries and feedback, but we decline unsolicited suggestions and ideas. Any enquiries, feedback, suggestions, ideas, or other information you provide (“Submissions”) are treated as non-proprietary and non-confidential. Subject to our Privacy Policy, by posting or transmitting any Submission, you grant us a non-exclusive, royalty-free, transferable, fully sublicensable right to use, reproduce, modify, adapt, publish, sell, assign, translate, create derivative works from, distribute, and display such Submission in any form or medium. Submissions may not be returned, and we may use any ideas, concepts, or know-how for any purpose, including developing, manufacturing, and marketing products.

By making a Submission, you represent and warrant that you own or control the rights in it; that it does not contain viruses, commercial solicitations, chain letters, mass mailings, or “spam”; and that you will not use a false email, impersonate others, or mislead us as to origin. You agree to indemnify us for all claims arising from your Submissions.

16. Use of Content You Submit

“Content” includes any materials displayed on or through the Website (ours or yours), including User-Generated Content and Third-Party Content.

No Reliance: User-Generated or Third-Party Content (e.g., reviews, blog posts, forums) is for information only and may not be accurate.

Feedback: Any comments or materials sent to us (e.g., suggestions, testimonials) are deemed the intellectual property of Realm Scents. We may reproduce, use, disclose, display, create derivative works, and distribute such Feedback without limitation or obligation, including for product/service improvement and marketing.

Licence Grant: To allow us to use Content you post without violating your rights, you grant us and our affiliates, successors, and assigns a worldwide, sublicensable, fully paid, royalty-free, non-exclusive licence to use, reproduce, display, modify, adapt, revise, distribute, and perform the Content for our business purposes. We may use or distribute User-Generated Content outside the Website; you acknowledge you are not entitled to royalties or revenue from such use.

Social Media: Our Website may connect to third-party networks where you can post Content. Do not publish personal financial information. You may log in using social credentials or link social accounts (e.g., Facebook) to your Realm Scents account, granting us permission to access information you’ve made shareable.

17. Representations and Warranties; Limitation of Liability

The Website is provided “as is.” We make no express or implied warranties regarding the Website or these Terms (including warranties of satisfactory quality, non-infringement, or fitness for a particular purpose), except where such warranties cannot be excluded by law.

To the fullest extent permitted by law, we are not liable (in contract, tort, or otherwise) for:
a) business interruption;
b) access delays or interruptions;
c) data non-delivery, mis-delivery, corruption, destruction, or other modification;
d) losses arising from off-Website links;
e) viruses, system failures, or malfunctions related to site use or third-party links;
f) inaccuracies, omissions, or misleading statements in content; or
g) events beyond our reasonable control.

To the fullest extent permitted by law, we are not liable for any direct, indirect, special, incidental, or consequential damages (including lost profits) related to the Website or purchased products, regardless of the form of action, even if advised of the possibility. Our maximum aggregate liability shall not exceed USD $100.00 plus the value of any defective products you purchased. In jurisdictions that do not allow exclusion or limitation of incidental/consequential damages, our liability is limited to the maximum extent permitted.

18. Indemnification

You agree to defend, indemnify, and hold us harmless from any losses, damages, or costs (including reasonable legal fees) arising from third-party claims related to your use of the Website, including use of robots, spiders, crawlers, or similar tools, or any action imposing an unreasonable load on our infrastructure.

19. General

These Terms, together with our Privacy Policy and Refund Policy, constitute the complete and exclusive agreement between us regarding your use of the Website and any purchases, and supersede all prior communications.

If any provision is found illegal, invalid, or unenforceable, the remaining provisions remain in effect. Any waiver by Realm Scents of a breach does not waive subsequent breaches and does not affect other provisions. No delay or failure to exercise a right operates as a waiver. Rights and remedies are cumulative.

Nothing herein creates an agency, partnership, or joint venture.

We may change these Terms at any time; please review them periodically. Changes take effect immediately upon posting. Continued use constitutes acceptance.

We may, with or without notice, terminate rights granted by these Terms. You must comply immediately with any termination notice, including ceasing all use of the Website.

We reserve the right to refuse supply to any person for any reason, withdraw goods, and remove or edit Website content. We will not be liable for withdrawing goods (sold or unsold), removing/editing content, refusing to process, or unwinding/suspending any transaction after processing has begun.
